Foreign Immigrants

The Foreign Immigrants Subcommittee provides legal support to foreign immigrants by conducting various public interests litigation including civil/criminal, family, and administrative litigation involving foreign immigrants. The Subcommittee won many cases and recent exemplary cases include the suit for a claim for handing over children and a claim for children rearing expenses, where the Subcommittee represented a mother from Pakistan who had been deprived of her children after a divorce. The Subcommittee also provides various legal advice to foreign immigrants in cooperation with relevant civic groups.

Other than providing direct support to foreign immigrants, the Subcommittee actively participates in improving relevant laws. In 2013, the Subcommittee, as a member of a task force team, participated in enacting a law regarding prevention of sexual violence and improvement of residential environment for foreign immigrants. In connection with this, the Subcommittee investigated residential status and sexual harassment and violence against foreign immigrants and conducted a research to present improvement methods.

In the area of foreign immigrants, close cooperation with relevant civic groups is very important. Therefore, the Subcommittee has actively interacted with other civic groups including Women Migrants Humanrights Center, Korean Food for Hungry’s Shelter for Female Immigrants, Korea Support Center for Foreign Workers, and Asia Chang, through which the Subcommittee was connected to foreign immigrants and represented them in various public interests litigation involving domestic violence, divorce, cancellation of non-allowance of simple naturalization, and claim for judgment regarding loss of parent right. Furthermore, the Subcommittee has made efforts to prevent sexual violence against foreign immigrants and to improve laws in respect of improvement of residential environments in cooperation with MNTV, a broadcasting company for foreign immigrants. It also provides various legal advice by signing an MOU on protection of foreign immigrants’ human rights with Jiguchon Sarangnanum.
